Sexual assault or abuse can have severe long-term physical, emotional, and psychological effects. The abuse not only impacts the victim but also has a ripple effect on all their relationships. According to the National Sexual Violence Resource Center, one in five women in the United States has experienced completed or attempted rape during their lifetime, and nearly a quarter of men experience some form of sexual violence in theirs. These statistics are staggering.
Sexual abuse and sexual misconduct are violent crimes that should always be reported to authorities. Someone who commits acts of sexual violence can face both criminal and civil penalties. If you are a victim of sexual violence, please get in touch with a compassionate personal injury attorney for a free, confidential consultation. There is never an obligation to prosecute your case, and we are happy to walk you through the process so you can fully understand your rights before deciding what is best for you. A civil case is separate from a criminal investigation, as its goal is to seek compensation for the harm and losses caused by the assault and to hold the responsible parties financially accountable. California law also recognizes that a civil claim may proceed even if no criminal prosecution is filed or if a criminal case does not result in a conviction.
A consultation with a San Francisco sexual assault attorney from our firm often starts with a discussion about what happened, what records exist, and what outcome feels right to the injured individual. Some sexual assault cases involve more than one liable party. Depending on the facts, civil liability may apply to organizations or businesses that:
Our San Francisco attorneys carefully investigate sexual assault injury claims to build a case based on fact, rather than assumptions. Evidence that may be used to prove liability in a sexual assault case includes:
We keep our clients informed throughout the investigation and claims process, while still protecting their privacy and individual needs.
Under California Code of Civil Procedure § 340.16, the deadline to file a civil sexual assault claim varies depending on the injured individual’s age at the time of the assault and the specific claim type. For many civil cases related to conduct that happened on or after the person’s 18th birthday, state law sets the filing deadline as the latter of either 10 years from the last act or 3 years from when an injury or illness caused by the assault is discovered.
Different rules might apply to claims of childhood sexual assault. For conduct that took place on or after January 1, 2024, there is no time limit for filing certain civil actions, whereas conduct before that date may be subject to different deadlines.
During an initial consultation, our San Francisco attorneys can diligently review claims to determine the appropriate filing deadlines. Our goal is to minimize the stress of our clients, handling the complex legal aspects of a case so they can focus on their personal well-being and healing.
